Technical clauses and responsibilities
These terms and conditions apply to all work carried out by Swisspool Liner LLC (hereinafter: Swisspool Liner), even if these terms and conditions have not been signed.
In case of any discrepancy in interpretation, the French version shall prevail.
1. Draining, preparing the surface, and checking after removal
The pool must be emptied before our arrival. Failure to comply with this condition may result in waiting time charges for emptying the pool at a rate of CHF 125/hour (+ VAT) per person.
Once the existing coating has been removed, we will check the surfaces to confirm their suitability as a substrate.
2. Structure, basin preparation, and drilling
The pool must be ready to receive a reinforced liner, according to the following criteria:
- Bottom and walls perfectly clean, smooth, without grain or apparent roughness. Cleaned with a pressure washer (or equivalent equipment) and disinfected.
- Coatings compatible with the reinforced membrane (no façade coatings or water repellents permitted).
- Right and sharp angles (especially vertical angles, steps, top/bottom of walls).
- Perfectly flat, smooth, relief-free top surface.
- HUNG profiles (where applicable) already in place and correctly installed.
- Pools intended to receive a reinforced liner must be drilled to allow condensation to escape. If the pool has not been drilled prior to our intervention, Swisspool Liner will carry out the drilling. In the event of water rising, Swisspool Liner cannot be held responsible for the consequences of water infiltration/rising.
In the event of non-compliance or defects (roughness, rust, masonry defects, etc.), corrective measures may be necessary (sanding, coating, treatment), carried out by us or a third party. These measures will be invoiced separately.
If the corrections are not applied, Swisspool Liner accepts no responsibility for the quality of the installation, in particular adhesion, flatness (creases) or durability.
If pool preparation is not included in our quote, only dust extraction will be carried out.
3. Plastics, flanges, screws, and sealing parts
For older pools, replacing flanges and seals on parts that need to be sealed can be complex, and sourcing materials can take time. In such cases, the agreed deadlines are extended accordingly.
Plastic components [1] can become dry, brittle, or fragile over time (due to UV rays, chemicals, freezing temperatures, etc.) and natural wear and tear. The same applies to seals.
- In the event of breakage, incompatibility, or inability to reassemble these components, Swisspool Liner accepts no liability.
- Flanges are not included in our service. In the event of subcontracting, they must be provided by the professional client (i.e., the pool contractor in charge).
- If the flanges are no longer commercially available, Swisspool Liner can offer to manufacture them to order (machining by a polymer engineer). The cost will be billed to the project owner.
- Any screws that are corroded, stuck, broken, or inaccessible and cannot be repaired by Swisspool Liner will be repaired by a third party and billed to the customer without any markup. The costs associated with removal or replacement (e.g., locksmith services, sealing, support adaptation) will be borne by the project owner.
All flange holes must be clear (no cement or obstructions, and screw threads must be functional). In the event of non-compliance, additional work may be charged.
4. Risks associated with the structure of light basins
Tanks made of sheet metal, steel panels, or other lightweight structures pose an increased structural risk, particularly when the tank is being emptied.
Risk of collapse: once emptied, a basin may deform, sag, or collapse if the backfill is insufficiently compacted, unsuitable, or has a pre-existing structural defect. This risk is particularly high for flexible or self-supporting basins.
Disclaimer: Swisspool Liner cannot be held liable for any instability, deformation, or collapse related to a structural defect or backfilling of lightweight pools.
Difficulties in dismantling may require additional work time, billed to the client.
5. Submerged shutter
If a submerged shutter is removed or tampered with, the operation of the motor (tubular or dry chamber) and associated components cannot be guaranteed, particularly in the case of old or worn equipment.
In the event of malfunction after intervention, without proven fault on the part of Swisspool Liner, we cannot be held liable.
Any repairs or replacements will be charged additionally.
6. Project modifications and work performed on a time and materials basis
Any service, supply, or intervention that is not explicitly mentioned in our offer or quote will be subject to:
- an additional estimate, or
- additional billing (either on a time and materials basis (time spent at CHF 125/hour and supplies), or re-invoicing by a third party).
This includes :
- any request for modification, adaptation or addition made by the customer,
- any intervention imposed by a technical constraint observed on site,
- any work that is not planned but necessary for the proper execution or durability of the work.
7. Warranty
Swisspool Liner is covered by the manufacturer's warranty for the reinforced membrane used:
- Waterproofing guarantee (material) 10 years for 150/100e, 180/100e or 200/100e membranes.
For the rest, the provisions of the Code of Obligations shall apply.
